This Code of Conduct is incorporated by reference into the TougeNation FallFest Participant Release, Waiver of Liability, and Assumption of Risk (the "Waiver"). By signing the Waiver, you agree to comply with all rules below. Violations are handled through the escalation process in §6, which ranges from a verbal warning to permanent ban depending on severity, and may affect the protections of the Waiver with respect to resulting injuries.
1. DRIVING RULES
- Obey all posted speed limits and Arkansas traffic laws at all times. No exceptions.
- Staff guide drivers are for navigation and route guidance only — not for pace-setting, driving instruction, or encouragement to drive faster than your comfort level.
- Minimum 3-second following distance between vehicles in convoy.
- No illegal racing, burnouts, drifting, or reckless driving on public roads, in parking areas, or anywhere on event property. This is a §6 step-3 offense — immediate removal without refund, no verbal warning stage.
- No alcohol or impairing substances before or during active route drives. Zero tolerance. This is a §6 step-3+4 offense — immediate removal without refund AND loss of Waiver protections for resulting injuries.
- Use turn signals for all lane changes and turns. Do not block intersections.
- If you fall behind the convoy, do not speed to catch up. Use the Google Maps route links provided at check-in to rejoin at the next waypoint. If you get lost, proceed to the next waypoint safely or return to event HQ.
- Registered driver only. Only the driver named on the booking may operate the vehicle during event routes. Passengers are prohibited from driving during any active route. If the registered driver becomes unable to continue (illness, mechanical, fatigue), the vehicle must exit the route and rejoin as a spectator; driver swaps are not permitted mid-event, except that a licensed passenger may operate the vehicle to reach a safe stopping point or medical facility in a genuine emergency.
- Passengers: must have signed the applicable waiver — the Adult Release for passengers 18 and older, or the Minor Assumption of Risk and Parental Consent for passengers under 18 (signed by a parent or legal guardian). The driver is responsible for confirming this. Passengers must wear seatbelts at all times.
- Vehicle condition: organizers may inspect vehicles before the route drive. Vehicles with observable safety defects (fluid leaks, inoperative lights, brake warnings, unsafe tires) will be removed from the route.
2. PARK ACTIVATION CONDUCT (FRIDAY)
- The Friday park activation is a public event. Respect the venue, other attendees, and the Springdale community.
- No driving on the park grounds except for staging, load-in, and load-out under staff direction.
- No open flames, no fireworks, no revving, no burnouts on event property.
- No selling merchandise outside of approved vendor booths. No soliciting.
3. RESPECT AND CONDUCT
- No physical altercations. This is a §6 step-3+5 offense — immediate removal without refund AND potential permanent ban.
- No threats, harassment, or intimidation of any kind — verbal, physical, or online. Arkansas law applies; event may involve local law enforcement as appropriate.
- Respect local communities. We are guests in Springdale and the surrounding Ozark region. Drive courteously through residential areas. Respect noise ordinances.
- Respect property — roadside businesses, residences, public infrastructure, other participants' vehicles, and venue property.
- Follow staff instructions. Event staff have full authority to enforce these rules. Staff decisions are final.
- No illegal substances. Arkansas law applies on event property and on event routes.
- No firearms except by on-duty law enforcement.
4. PHOTOGRAPHY, DRONES, AND LIVESTREAMING
- Official event photography, videography, and drone footage are produced by TougeNation LLC or its designees. Participants grant a royalty-free license for use of their likeness through the Participant Waiver signed at registration.
- Personal photography is welcome and encouraged. Be courteous — ask before photographing close-ups of individuals, families, or minors.
- Drone operation by participants is prohibited without prior written permission from TougeNation LLC and a valid FAA Part 107 commercial drone license.
5. MINORS
- All minors must be accompanied by a parent or legal guardian at all times during the event.
- Minors may participate as passengers only after completing the Minor Assumption of Risk and Parental Consent form, signed by a parent or legal guardian.
- Lost minors: report to event HQ immediately. Staff will page the parent/guardian.
6. REPORTING AND ENFORCEMENT

What to report:
- Violations of this Code of Conduct
- Safety concerns (vehicle, road, venue)
- Lost or missing persons
- Medical concerns
- Any incident that may result in a claim
Enforcement escalation:
- Verbal warning for minor first-time infractions
- Removal from active convoy for safety-related infractions
- Immediate removal from the event without refund for serious or repeated violations
- Loss of Waiver protections for injuries resulting from rule violations
- Permanent ban from future TougeNation events at the organizer's discretion
Staff decisions are final. There is no appeals process for in-event decisions.
